Public Hearing for Joyce BoreyÕs request to have Condition #5
on her previously approved subdivision removed, which required a cistern be
installed for fire protection prior to the sale of Lots 16-77-6 through 10:
Hatch
opened the Public Hearing at 6:30PM and explained why we were here. He asked
Borey if she wanted to speak on the request and she declined. Hatch presented
the written opinion of Fire Chief Atkins saying that he reviewed the
Subdivision Regulations and did a site visit to review the conditions of the
area. He measured from the existing Island Pond Road 10K gallon cistern and
found the distance adequate to meet the regulations. He felt that the outflow
of Freezeland Pond was also an adequate year-round water source for these lots.
He didnÕt feel that another cistern would be required. J. Bruno asked if this
was a new subdivision. Schwartz answered that no new lots were being created
this was an existing subdivision that her lot was a part of. We are merely
considering a condition that was part of the approved existing subdivision.
Lawrence asked if the Select Board has an opinion on it. Hatch said they have
been working with Borey on this and have had input on it. Crandall added that
this is a Planning Board decision. Lawrence said he is supportive of BoreyÕs
request. J Bruno asked if this is a stipulation on any other lots in town.
Hatch answered that this is a requirement stated in the Subdivision Regulations
on any new subdivisions proposed in town. Hatch asked if there were any other
questions or comments, there being none Hatch closed the Public Hearing at
6:36PM and opened the regular meeting.

Planning Board Meeting Ð
Crandall made a motion to approve the request based on the letter of
recommendation from Fire Chief Atkins dated August 2, 2022 and previous
discussions of new equipment that the Fire Department has acquired since the
original subdivision application was approved with the condition, Kluk seconded
the motion and all voted in favor. Borey asked what will happen next. Schwartz
said that we need to write a ÒLetter of DecisionÓ and take it to the Registry
of Deeds for registering and Borey will receive a copy of that letter.
